Triaging Deadline-Driven Calls (RFEs and NTAs)

A caller holding an RFE or a Notice to Appear can't wait in the normal consult queue. Here's a simple triage system for deadline-driven immigration calls.

Some immigration calls can sit in your normal consult queue for a few days. Calls about a Request for Evidence or a Notice to Appear can't. The caller is holding a document with a date on it, and if your intake treats them like a general inquiry, the date can pass before an attorney ever sees the file.

The fix isn't heroic effort. It's a simple triage system your intake team uses on every call, so deadline cases get pulled out of the pile in the first two minutes.

Know the two documents

Intake staff should recognize both on sight, or from the caller's description.

Request for Evidence (RFE). Sent by USCIS when it wants more documents or information on a pending application or petition. It has a response deadline printed on it. Under the USCIS Policy Manual, the response period for an RFE is capped at 12 weeks and a Notice of Intent to Deny (NOID) at 30 days. Officers can set shorter windows, and the deadline generally can't be extended. USCIS also changed its evidence guidance in August 2026, so don't assume the window is what your firm is used to. The date on the notice is the one that counts.

Notice to Appear (NTA). The charging document that starts removal proceedings in immigration court, which is part of the Executive Office for Immigration Review (EOIR). It may or may not include a hearing date. Missing a hearing can lead to an order of removal in absentia, meaning without the person there. That's why every NTA call is urgent, even when the hearing seems far off.

These rules change. Have your attorneys confirm current procedure and update your intake scripts when it shifts.

Ask the deadline question early

Most intake scripts start with name, phone and "what can we help with?" For an immigration firm, add one question right after that:

"Have you received any letter or notice from USCIS, immigration court or ICE that has a date on it?"

If the answer is yes, switch to the deadline track. Everything else can wait until the date is captured.

The deadline track: what to capture

For an RFE or NOID

  • Which form or case it relates to (for example, the form number on the notice).
  • The receipt number.
  • The date printed on the notice.
  • The response due date printed on the notice.
  • The date the caller actually received it.
  • Whether another attorney or preparer filed the original application.
  • Whether they can send a photo or scan of the full notice today.

For an NTA or hearing notice

  • Full name and A-number from the notice.
  • Hearing date, time and court location, if listed.
  • Whether the person is detained.
  • Whether they've had any hearings already, or missed any.
  • Whether they have, or had, a lawyer on the case.

If they don't know the hearing date, staff can check EOIR's Automated Case Information online or by phone at 1-800-898-7180 using the A-number. EOIR notes that the court's official notices control, so ask for those too.

A simple three-tier triage

Agree on tiers with your attorneys and write them down. Here's a starting point to adapt.

| Tier | Examples | Who's told | How fast | |---|---|---|---| | Red | Person detained. Hearing coming up very soon. RFE or NOID due very soon. Missed hearing or removal order. | On-call attorney, by phone and text | Same day, including after hours if your firm allows | | Amber | NTA with a hearing further out. RFE with more time left. A denial the caller just received. | Responsible attorney | Within one business day | | Green | No notice, no date. General questions about options. | Normal consult booking | Standard schedule |

Your attorneys should set the exact cutoffs, such as how many days counts as "very soon." Then train every person who answers the phone on them. A tier system only works if the 8 p.m. call gets sorted the same way the 10 a.m. call does.

Script lines that keep intake on the right side of the line

Deadline callers want answers. "Can I get an extension?" "Do I really have to go?" "What documents should I send?" Those are legal questions. Intake staff shouldn't answer them, even when they think they know.

Use lines like these instead:

"I'm marking this as urgent so an attorney sees it today. I'm not able to give advice on what to send, but they will."

"Please don't send anything to USCIS until you've talked with the attorney."

"Please don't make any decisions about your hearing until you've talked with an attorney."

"Can you text a photo of the whole notice, front and back, to this number? That helps the attorney get started faster."

If your firm accepts documents by text, say so on the call. Getting the actual notice in hand early is the best thing intake can do for a deadline case. Our post on phone intake vs. online forms covers collecting documents during intake.

Make the deadline impossible to miss

Once a deadline case is in your system, the date has to be visible to everyone who touches the lead.

  • Put the due date or hearing date in the lead's title or a dedicated field, not buried in notes.
  • Assign one owner.
  • Set an internal date well ahead of the real one so there's time to prepare.
  • Confirm the consult with the caller by text and phone.

The worst version of this is a Red call that comes in Friday night, gets a polite voicemail, and is found Monday afternoon.

After-hours deadline calls

Deadline calls don't respect business hours. A person who opens an NTA at 9 p.m. is calling at 9:05. Decide now how Red calls reach a person after hours, and make sure whoever or whatever answers your phone knows the rule. Our after-hours intake post has more on setting that up.

Review the misses

Once a month, look at every deadline call you took. How fast did each one get to an attorney? Did any Red call sit too long? If one slipped, find the step where it stalled and fix that step. Small firms don't need a big process for this, just an honest look.
